Terms & Conditions

1. Definitions

• “Platform” means the AustralianEdu.au website and all associated digital services.
• “User” means any individual who accesses or uses the Platform, including parents, guardians, students, and school administrators.
• “Content” means all mock exams, practice tests, questions, solutions, reports, images, videos, and educational materials available on the Platform.
• “Account” means a registered user profile on the Platform.
• “School Licence” means a multi-user licence purchased by an educational institution.

2. Eligibility & Account Registration

• You must be at least 18 years old to create an account. If you are under 18, a parent or legal guardian must register on your behalf and supervise your use of the Platform.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must provide accurate and current information during registration and keep your account details up to date.
• Each account is for individual, personal, non-commercial use unless a School Licence has been purchased.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Products & Services

• AustralianEdu.au provides digital mock exam packs, practice tests, progress analytics, and educational resources.
• All Content is delivered digitally via our online Platform — no physical materials are shipped.
• Access to purchased packs is granted for 12 months from the date of purchase unless otherwise stated at the time of sale.
• Membership subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting us.
• We reserve the right to update, modify, replace, or discontinue any Content or pricing at any time without prior notice. Changes will not affect Content already purchased.
• Free trial or sample Content may be withdrawn or modified at our discretion.

4. Pricing & Payment

• All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable.
• Payment is processed securely via Stripe. We do not store or have access to your credit/debit card details.
• You agree to pay all fees and charges associated with your purchases at the prices in effect at the time of purchase.
• We reserve the right to change pricing at any time. Price changes do not affect existing purchases or active subscriptions until renewal.

5. Intellectual Property

• All Content on the Platform, including but not limited to exam questions, solutions, explanations, images, branding, logos, design, and software, is the exclusive intellectual property of AustralianEdu.au or its licensors and is protected by Australian and international copyright law.
• You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use purchased Content for personal educational purposes only.
• You may not reproduce, distribute, share, upload, publish, sell, sublicense, or create derivative works from any Content without our prior written consent.
• Taking screenshots, recordings, or copies of exam Content for redistribution, tutoring, or commercial purposes is strictly prohibited and may result in legal action.
• All trademarks, service marks, and trade names used on the Platform are the property of their respective owners.

6. User Conduct

You agree not to:

• Share your login credentials or allow others to access your account.
• Use automated tools, bots, scrapers, or scripts to access or extract Content from the Platform.
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or our systems.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Submit false, misleading, or fraudulent information.
• Distribute exam Content to tutoring centres, coaching schools, or competitors.

Violation of these rules may result in immediate account termination without refund and may lead to legal proceedings.

7. Limitation of Liability

• AustralianEdu.au provides exam preparation materials for practice purposes only. We do not guarantee specific exam outcomes, scores, school placements, or scholarship awards.
• To the maximum extent permitted by Australian law, including the Australian Consumer Law (ACL), our total liability to you for any claim arising from or related to the Services shall not exceed the amount you paid for the specific product or service giving rise to the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the ACL or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Indemnification

You agree to indemnify, defend, and hold harmless AustralianEdu.au, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, violation of these Terms, or infringement of any intellectual property or other rights of any third party.

9. Termination

• You may close your account at any time by contacting us at admin@australianedu.au.
• We may suspend or terminate your account immediately, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or misused the Platform.
• Upon termination, your right to access purchased Content ceases immediately. No refund will be provided for termination due to Terms violations.
• Provisions relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet outages, cyberattacks, or infrastructure failures.

11. Dispute Resolution

• If you have a dispute regarding our Services, please contact us first at admin@australianedu.au. We will attempt to resolve the dispute in good faith within 14 business days.
• If the dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing any legal proceedings.
• Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts of appeal therefrom.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and AustralianEdu.au regarding your use of the Platform and supersede all prior agreements, representations, and understandings.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
